Terms of Service

1. Scope

These Terms of Service (the “Terms”) govern access to and use of the Tiny Imps app, the imps it installs and the website tinyimps.com (together, the “Services”), provided by Tiny Imps (“Tiny Imps”, “we”, “us”). By purchasing a subscription, starting a trial or using the Services, you accept these Terms. Use of the software is also governed by the End-User Licence Agreement, and personal data is processed as described in the Privacy Policy.

2. Purchase

Subscriptions are sold by Creem, acting as merchant of record. Creem processes the payment, collects applicable taxes and issues invoices; its buyer terms apply to the payment transaction.

3. Subscription

A subscription grants the right to use the imps included in the selected plan for as long as the subscription remains active, on the number of computers permitted by the plan, signed in with the e-mail address used for the purchase. Signing in on a further computer may sign out another. Updates are provided and installed automatically while the subscription is active.

4. Trial

Tiny Imps may offer a free trial for the period stated on the website. A trial is provided for evaluation only. Tiny Imps reserves the right to refuse, limit or end a trial that is used to avoid payment.

5. Price, renewal and cancellation

A subscription renews automatically at the end of each billing period at the price shown at checkout, until it is cancelled. An introductory price, where offered, applies only to the period shown at checkout; the subscription then renews at the regular price shown at checkout. Current prices are published on the pricing page. A price change does not apply to a billing period that has already been paid.

You may cancel at any time under Manage subscription in the Tiny Imps app or in Creem’s customer portal. Cancellation takes effect at the end of the current billing period, and no further payment is charged. Refunds are governed by the Refund Policy.

6. Acceptable use

You may not share an account beyond the computers permitted by your plan; sell, rent, lend or sublicense the Services; modify, decompile or reverse engineer the Services or circumvent their licence check, except to the extent permitted by applicable law; or use the Services with material that you do not have the right to use.

7. Intellectual property

The Services, including the machine-learning models they contain, are the property of Tiny Imps or its licensors. All rights reserved. The models may be used only within the Tiny Imps app. They may not be extracted from it, and neither the models nor their outputs at scale may be used to develop other software or services or to train other models. Content that you create with the Services remains yours.

8. Operation of the Services

The Services verify the licence periodically and may operate without an internet connection for a limited period. Tiny Imps reserves the right to modify the Services, including by adding, changing or removing features.

9. Disclaimer and limitation of liability

The Services are provided “as is” and “as available”, without warranties of any kind, to the extent permitted by applicable law. You are responsible for keeping backups of your projects. To the extent permitted by applicable law, Tiny Imps is not liable for any indirect, incidental or consequential damages, and its total liability is limited to the amounts you paid for the Services in the twelve months preceding the claim. Nothing in this document limits rights that cannot be limited under applicable consumer protection law.

10. Suspension and termination

Tiny Imps may suspend or terminate access to the Services if these Terms are breached. Upon termination, the right to use the imps ends. Content created with the Services is not affected.

11. Changes to these Terms

Tiny Imps reserves the right to amend these Terms. Amended Terms are published on this page before they take effect. Continued use of the Services after that constitutes acceptance; you may cancel instead.

12. Governing law and contact

These Terms are governed by the laws of the Republic of Türkiye, without prejudice to the mandatory consumer protection rules of your country of residence. All notices and requests are to be sent to support@tinyimps.com.
